How to get a gambling licence in Bosnia and Herzegovina
Bosnia and Herzegovina has no state-level gambling regulator or statute. The Federation of BiH (FBiH), Republika Srpska (RS) and Brčko District (BD) each license their own market through their own authority, and the three routes differ in what they allow online, in fees, capital, guarantee, tax and local presence.
- 1Pick the entityThere is no state licence. FBiH gives an internet approval for betting only, RS an internet-games licence, and BD an internet approval on top of the approval for the underlying game.Decide first
- 2Set up a company in that entityThe holder must be a legal person seated in the entity; a foreign branch is not accepted. Minimum capital is KM 1,500,000 in FBiH and KM 1,000,000 in RS; BD sets it for the underlying game.Local seat
- 3Certify the software and place the serverA laboratory certificate for the internet system comes with the application, and the server and data stay in the entity (BD: in Bosnia and Herzegovina). Before filing
- 4File a request and pay the feeSend the request to the Federal Ministry of Finance, the RS Ministry of Finance or the BD Tax Administration. The fee is KM 150,000 in FBiH and KM 300,000 in RS; BD has none for the internet approval itself.KM 150,000 to 300,000
- 5Operate and pay monthlyPay the operator fee every month: 5% of each player payment in FBiH, 20% of payments less payouts in RS, and in BD KM 1,500 per operator seat until 31 July 2027 at the latest, then 20%.5% to 20%
- A company seated in the entity: FBiH, RS or BD
- Capital of KM 1,500,000 (FBiH) or KM 1,000,000 (RS)
- A bank guarantee: KM 800,000 in FBiH, KM 200,000 in BD, 25% of planned annual fee costs in RS
- A laboratory certificate for the internet system
- A server and data in the entity (BD: in Bosnia and Herzegovina), open to the supervisor
FBiH gives an internet approval for betting only; RS gives an internet-games licence that covers casino games from its Catalogue; BD gives an internet approval on top of the approval for the underlying game. As of 27 October 2026 nine bills to amend the FBiH Law on Games of Chance are listed in procedure in the FBiH House of Representatives, and a state bill to end the VAT exemption awaits the House of Peoples; none is law.
This guide covers getting licensed. For running the business, tax, advertising, bonus rules, payments and enforcement, see the Bosnia and Herzegovina operator overview; for whether it is legal and safe to play, the Bosnia and Herzegovina player guide.
No state regulator: three licensing orders
Each entity regulates its own market. The state level legislates only on VAT, anti-money-laundering, payments supervision, competition and data protection.
| Entity | Licensing authority | Supervising authority | Online route |
|---|---|---|---|
| FBiH | Federal Ministry of Finance; the Minister decides the approval | The Ministry and the Federation Tax Administration, which watches operators’ central servers online and runs inspections | Special internet approval for betting; Lutrija BiH holds online classic (lottery) games by statute |
| RS | Ministry of Finance of RS, which grants licences and approves computer systems | The Ministry and the Republic Administration for Games of Chance (RUIS), a body within the Ministry seated in Banja Luka | Licence for internet games of chance; Lutrija Republike Srpske holds lottery and electronic games |
| BD | Tax Administration of BD, which decides approvals | The Tax Administration; the District Directorate for Finance issues the implementing rulebook | Internet approval, a further Tax Administration decision on top of the approval for the underlying game |
- There is no separate advertising regulator: the games-law authorities enforce the advertising rules, and for broadcast the state Communications Regulatory Agency (RAK) applies its Code in all three entities.
- Anti-money-laundering supervision is split by entity: the Federal Administration for Inspection Affairs in FBiH, RUIS in RS and the Directorate for Finance in BD.
Laws that apply

Choosing an entity: betting in all three, online casino only in RS and BD
The three licences are not interchangeable. FBiH bans collecting stakes on its territory for foreign games or games of another entity or the District, and RS and BD ban internet operators from abroad. Whether an operator licensed in another entity counts as “from abroad” under the RS and BD bans is not stated in either Act.
| Entity | What the licence allows online | Who may hold it | Term |
|---|---|---|---|
| FBiH | Betting only. Private operators have no online casino approval; online classic (lottery) games are the exclusive right of Lutrija BiH | A betting operator already approved for at least 50 payment points, seated in the Federation | Two years for the betting approval; the internet approval runs to the same date |
| RS | Internet games of chance in a class of their own, casino games included; only games described in the Catalogue of games of chance may be offered | A legal person seated in RS whose founders or responsible person have no convictions other than traffic offences | Five years, extendable repeatedly for five years |
| BD | Internet approval for the special and electronic games of the underlying approval (betting, casino, slot machines, electronic games); the text does not limit online play to betting | An operator holding the underlying approval, seated in BD; lottery games run only through the branch of an entity lottery | The period of the underlying approval: betting two years, casino five |
| Entity | One-off fee | Minimum capital | Guarantee | Operator fee |
|---|---|---|---|---|
| FBiH | KM 150,000 for the internet approval, on top of KM 150,000 for the betting approval | KM 1,500,000 for the internet approval, beside KM 1,000,000 for the betting approval | KM 800,000, beside KM 600,000 for the betting approval | 5% of every player payment, withheld from the player; Lutrija BiH 10% of online turnover |
| RS | KM 300,000, one-off, not refundable if the licence is not used | KM 1,000,000 for internet games, added up for every licence held | 25% of the total planned annual costs based on the fees, delivered by 31 January each year | 20% of total payments less total payouts, by the 15th of the following month |
| BD | None for the internet approval itself; the underlying game’s fee applies (betting KM 20,000 per betting shop for two years; casino KM 500,000 for five years) | No internet figure; betting KM 100,000, casino KM 1,000,000 | KM 200,000 for internet games, cumulative per game (betting shop KM 3,000; casino KM 500,000 on top) | KM 1,500 a month per operator seat until the Tax Administration information system exists, 31 July 2027 at the latest; then 20% of payments less payouts, by the 10th |
| Entity | Local presence | Server and data | Local management and bank | Decision time |
|---|---|---|---|---|
| FBiH | A company seated in the Federation; no branch of a foreign company is accepted | Server and its room on the Federation’s territory, operator-owned, permanently connected to the Tax Administration | No local director rule; the guarantee comes from a bank seated in the Federation | No deadline in the games law; the procedure law fixes 30 days, or 60 where a special examination is needed |
| RS | A legal person seated in RS; operators from abroad are barred | Hardware and software in the Republic; all data stored there and available online to the Ministry | Director, chief accountant and other authorised persons employed for an indefinite period and resident in RS; accounts at a bank seated in RS or with a unit there | No deadline in the games law; the procedure law (original text) fixes one month, or two where a special examination is needed; the licence decision is final |
| BD | A legal person seated in BD; operators from abroad are barred | Computer system and data in Bosnia and Herzegovina (the original text said the District); connection to the Tax Administration system postponed to 31 July 2027 at the latest | No residence rule for management; the operator’s bank account is opened in Bosnia and Herzegovina | No deadline in the games law; 15 days, or 30 where a special examination is needed; appeal to the Appellate Commission within 15 days |
Online products by law, and how operators sell them
The registers do not list products; the laws fix what may be offered online. Operators’ own sites show more than FBiH law allows its approved operators.
| Product | FBiH | RS | BD |
|---|---|---|---|
| Sports betting | Licensed: internet approval for betting operators, and Lutrija BiH | Licensed: internet licence | Licensed: internet approval |

Who can apply: a local company, clean owners, documented funds
In all three entities the holder is a legal person seated in that entity. No text accepts a branch or permanent establishment of a foreign company, and no text treats an EU or EEA company differently from any other.
| Entity | Who is tested | Test | Change of ownership |
|---|---|---|---|
| FBiH | Founders and authorised persons | No criminal conviction except traffic offences; notarised statement of no earlier withdrawal of an approval and no conviction for tax evasion; proof of paid taxes; bank certificate on the origin of the funds | Prior consent of the Ministry; an unconsented change can cost the approval |
| RS | Founders or the responsible person | No conviction except traffic offences; the Ministry assesses the tax compliance of the company and its owners; statement on earlier withdrawal and tax and contribution evasion | No article on consent to a change of shareholders |
| BD | Founder, manager and persons linked to ownership or management | Not sentenced to imprisonment of more than three months, except for traffic offences; bank certificate on the origin of funds not older than 30 days | Prior consent of the Tax Administration |
- A foreign company, EU or non-EU, takes part only by incorporating a company in the Federation, in RS or in the District; foreign ownership of that company is not barred in the three Acts.
- Whether capital must be paid up is not stated for the online approvals; FBiH asks for proof of payment of the cash part for the casino company alone.
- No Act lists an ultimate-beneficial-owner declaration; the state anti-money-laundering law applies to operators as obliged persons.
- No text states how many brands, domains or websites one licence may cover. RS and BD require the operator to provide an internet domain, and each site shows the licence or approval number.
Fees, capital and guarantee: the first-year floor
Capital, guarantee and fee add up for each game an operator offers. The table gives the fees stated in the laws for starting an online betting business, with our arithmetic.
| Entity | One-off fees | Minimum capital | Guarantee |
|---|---|---|---|
| FBiH | KM 150,000 (betting approval) + KM 150,000 (internet approval) + 50 x KM 10,000 for the 50 payment points the internet approval requires = KM 800,000; whether points opened before the approval are charged is not stated | KM 1,500,000; the Act does not say whether capital and guarantees add or overlap | KM 800,000 + KM 600,000 = KM 1,400,000 |
| RS | KM 300,000 | KM 1,000,000 | 25% of the total planned annual costs based on the fees; depends on the plan |
| BD | Base game: betting KM 20,000 per shop for two years; internet charge KM 1,500 per operator seat a month until the Tax Administration system exists, 31 July 2027 at the latest | No internet figure; betting KM 100,000 | KM 200,000 (internet) + KM 3,000 per betting shop |
| Entity | Filing deadline | Fee |
|---|---|---|
| FBiH | At least 30 days before expiry; late evidence loses the right to apply again for an extension | KM 50,000 (betting) and KM 50,000 (internet approval) |
| RS | At least six months before expiry; repeatable for further five-year terms | None named |
| BD | 30 days before expiry; evidence filed after the additional deadline turns the request into a new application | None named for the internet approval; the underlying game’s renewal fee applies (betting KM 10,000 per shop) |
- No separate application fee is named in any of the three Acts: the licence fee is paid before or with the request and its proof is attached.
- No annual licence fee is named for online operations: the fee is paid at issue and renewal (FBiH) or once (RS, BD).
- No levy for responsible gambling is imposed on the operator; the public authority allocates fee revenue, partly to addiction treatment and prevention.
- Certification and technical inspection are at the operator’s cost. In RS the technical inspection of internet-game technology costs KM 1,400 the first time and KM 1,000 each later time.
Application: documents, certification and decisions
Each Act provides for a request to the licensing authority and sends procedural questions to the general administrative-procedure law (in BD, to the Law on the Tax Administration). None states a filing channel or a prescribed form, and none sets an application window for first-time online approvals.
| Entity | Documents |
|---|---|
| FBiH | Company data; court registration decision and the valid Ministry approval; game rules; server serial number and proof of where it stands; notarised statement of the software maker (no hidden functions); tax clearance; proof of no convictions; proof of experience; bank guarantee or proof of the earmarked deposit |
| RS | Company data and registration decision; proof of the KM 300,000 fee; general rules; tax clearance; proof of seat premises; proof of an open bank account; server serial number and place; software maker’s statement; proof of an approved and certified computer system |
| BD | Registration with the Basic Court; payment of the one-off fee; capital and proof of its origin; bank guarantee or earmarked deposit; rules for each game; tax clearance 30 days before filing; certified computer system; for internet games, a certificate for internet games, technical inspection and proof of an existing approval for the underlying games |
| Entity | Requirement | Issuer |
|---|---|---|
| FBiH | Test certificate of the internet system’s software, submitted with the application; re-certification before any software change | A body recognised as an accreditation body in the country or abroad; the Law speaks of an authorised laboratory |
| RS | An approved and certified computer system; a certificate and technical report for every game on the system | A laboratory accredited to ISO/IEC 17025 and 17065 for gambling technology |
| BD | Certificate of conformity for the computer system for internet games; existing operators had until 31 December 2025 | A laboratory authorised by the Director of the Directorate for Finance |
- The games laws set no decision deadline of their own: the procedure laws fix 30 to 60 days in FBiH, one to two months in RS (original text) and 15 to 30 days in BD.
- Grounds for refusal follow from a missing condition; RS adds an assessment of business record, solvency, tax compliance, saturation of the offer and fit with the tourist offer.
- The RS licence decision is final and open to no administrative appeal; in BD an appeal lies to the Appellate Commission within 15 days; the FBiH Act names no appeal body for a Ministry refusal.
- No general pre-licensing approval exists; the Ministry’s consent attaches to specific steps, such as game rules in FBiH or the computer system in RS.
Technical rules: servers and data stay in the entity
Server, hardware or computer system must be on the territory of the entity (BD: Bosnia and Herzegovina), and no instrument mentions cloud hosting. Because the hardware must be owned by the operator in all three, a provider-owned cloud does not meet the ownership rule as written.
| Entity | Connection to the regulator | Data retention |
|---|---|---|
| FBiH | Central server in direct on-line link with the Tax Administration, with continuous access to player accounts, balances and transactions | No retention period stated for internet-game data |
| RS | Real-time Ministry access to supervise financial transactions; each transaction sent to the supervision system within 90 seconds | Copies of data and financial transactions at least five years from the transaction |
| BD | Continuous connection to the Tax Administration system written into the law but postponed to the date the system exists, 31 July 2027 at the latest | Access for the Tax Administration to the last five years |
- No named game-testing standard appears in any entity; RS and BD name ISO/IEC 17025 for the testing laboratories, and FBiH names no standard.
- No RTP floor or ceiling, stake or jackpot cap, minimum spin time, autoplay or bonus-buy rule is set for online games. The only RTP figure is for land-based machines.
- No geolocation duty is placed on the operator, and no local top-level domain is prescribed.
- Accepted laboratories are those each entity authorises or recognises: the FMF names five for machines and RNG, the RS Ministry five (four within their printed validity on 27 October 2026), the BD Directorate four on its notice of 21 August 2026.
Operator fee and tax: 5% in FBiH, 20% in RS, a flat fee in BD for now
There is no state-level gambling tax: each entity charges an operator fee under its own games law. The date in BD’s Art. 114a, 116a and 116b moved from two years after SG BD 24/22 entered into force, to 31 July 2025, then to 31 July 2027.
| Entity | Fee | Base | Paid |
|---|---|---|---|
| FBiH | 5% of each individual player payment (the stake is the payment less the fee), withheld from the player; Lutrija BiH 10% of online turnover | Player payments (turnover); payouts are not deducted | Lutrija BiH’s fee by the 10th of the following month |
| RS | 20% | Total payments minus total payouts, monthly | By the 15th of the following month |
| BD | KM 1,500 a month per operator seat until the Tax Administration information system exists, 31 July 2027 at the latest; then 20% | Total payments minus total payouts | By the 10th |
| Tax | Rule |
|---|---|
| Corporate income tax | 10% of the taxable profit in all three entities; no different rate for gambling operators |
| VAT | Games of chance are exempt at state level (VAT Act Art. 25 point 7); the standard rate for other supplies is 17% |
| Tax on player winnings | FBiH 10% of each winning above KM 100; RS 10% to 30% in four bands above KM 1,000; BD 10% on the part of a lottery winning above KM 100 and 25% on casino winnings, none on betting or internet winnings. The operator withholds it |
- Only RS addresses bonuses: a promotional bonus counts as a payment in the game and is deducted from a winning made with it, and nothing lets an operator deduct bonuses or jackpots from the fee base.
- No advertising or sponsorship tax and no extra contribution beyond the fees is imposed on the operator.
Player protection: age 18 everywhere, limits only in RS and BD
The minimum gambling age is 18 in all three entities, and online play is covered expressly.
| Measure | FBiH | RS | BD |
|---|---|---|---|
| Stake limits | None | Daily, weekly and monthly limits offered; player-set highest loss | Daily, weekly and monthly limits offered |
| Self-exclusion | No provision | Programme for internet operators, for the period the player requests | Programme for operators of special and electronic games, for the period the player requests |
| Identity checks | At registration and every order; qualified electronic certificate or inspection of a valid ID document | Age check at registration; registration confirmed at every payment and payout | Registration confirmed at every payment and payout |
| Payout deadline | At the latest within three days of a written request | No statutory deadline | No longer than 60 days from the final result for special and electronic games |
| Complaints | Procedure required in the internet system | No procedure article; general rules name the court | No procedure article |
- No national self-exclusion register exists, so self-exclusion is a programme each operator runs and does not apply across operators.
- No independent ADR provider is required; in RS, RUIS inspectors must take up players’ requests and reports.
- Player funds: FBiH requires separate bank accounts, and in all three the money on the operator’s account must at least equal the total on players’ virtual accounts.
- Cards are named as a payment method in RS and BD; cryptocurrency is not mentioned in any instrument.
Advertising: allowed for approved operators only
All three entities ban advertising of operators without an approval or licence, and of foreign games or tickets. Television, radio and online advertising by approved operators is permitted, with children’s-media limits.
- Broadcast: gambling advertising may not be shown in the 15 minutes before, during and 15 minutes after a children’s programme (RAK Code); no watershed applies.
- BD: every advertisement other than a display of the operator’s logo or trade mark carries the notice of the ban on minors, the addiction warning and the statement that playing is not a reasonable strategy for financial gain.
- RS: the responsible-gaming Rulebook bars advertising aimed at vulnerable groups or at persons below the legal age and advertising that suggests gambling is a reasonable strategy for financial gain, and asks for a responsible-gaming message and the helpline number where appropriate.
- FBiH: advertisements are barred in children’s and youth media, including internet portals aimed at them; the warnings sit on the operator’s website.
- No rule covers sports sponsorship, influencers, affiliates or social media as such; the general bans apply to them.
Anti-money-laundering: one state law, three supervisors
The state AML/CFT Law (SG BiH 13/24, in force 27 February 2024) makes a games-of-chance organiser an obliged person in all three entities. Game organisers had to comply by 27 August 2024.
- Registration on an electronic betting platform triggers identification, verification and monitoring whatever the stake; any in-game transaction of KM 2,000 or more, single or linked, triggers identification and monitoring.
- Any suspicion, whatever the amount, is reported to the financial intelligence unit before the transaction, or at the latest the next working day where that is impossible; cash transactions of KM 30,000 or more go within three days.
- Customer and transaction records are kept for ten years from the end of the relationship, transaction or identification.
- No local money-laundering reporting officer is required: an authorised person and deputies are appointed and notified to the unit within eight days, with no residence or seat requirement.
Suppliers: no B2B licence, but certified software and approved labs
No B2B operating licence exists in any entity. A supplier is bound through what the operator’s software and hardware must satisfy, and suppliers appear as approved or authorised bodies.
- Software must be made by a company registered under the software-production law and certified by an authorised laboratory; the maker’s sworn statement of no hidden functions goes with the operator’s application.
- Laboratories and technical-inspection bodies are authorised by the regulator (five-year terms in RS and BD); in RS, payment intermediaries need Ministry approval, with a seat in RS and at least KM 5,000,000 of turnover in gambling payment mediation.
- No supplier register, no affiliate or marketing-agency licence and no recognition of a foreign supplier licence exists; foreign test evidence is accepted through recognised or authorised laboratories.
- No gambling-specific tax falls on supplier revenue; all three entities withhold 10% on payments to foreign legal persons for royalties and for management and consulting services, unless a double-taxation treaty lowers it.
Registers and enforcement
FBiH and RS publish PDF registers and BD publishes none. No entity publishes a list of suspended or revoked approvals.
| Entity | Fine on the legal person | Other |
|---|---|---|
| FBiH | 5,000 to 12,000 for internet games contrary to the Law; 10,000 to 15,000 for hardware and software not on FBiH territory or not connected; 12,000 to 15,000 for the monthly fee wrongly calculated or paid late | Responsible person 1,500 to 3,000 (Art. 129) or 2,000 to 3,000 (Art. 130) |
| RS | 20,000 to 50,000, including internet games contrary to Arts. 85 to 93 | Responsible person 5,000 to 10,000; confiscation of the internet server and software in set cases |
| BD | 5,000 to 30,000, including internet games without approval | Responsible person 1,500 to 5,000; a 30-day or six-month ban by the court |
- The FBiH Tax Administration reported on 2 April 2026 that it ran 1,062 inspections of betting operators in March 2026, with misdemeanour orders in 241 and fines totalling KM 949,550.
- Only RS has a written site-blocking and payment-blocking rule: the Ministry sends banks a list of sites whose payments they may not execute and starts a procedure to block access in RS.
- RS makes unauthorised organisation of prohibited games a crime (Criminal Code Art. 368, fine or prison up to one year); no equivalent offence appears in the FBiH or BD criminal-code texts cited.
- The revocation grounds run to 12 in FBiH, 8 in RS and 13 in BD, among them false data, unpaid public revenue or winnings, obstructing supervision and capital not maintained.
What a gambling licence in Bosnia and Herzegovina costs

| Guarantee | KM 800,000 / 200,000 | FBiH / BD; RS 25% of the total planned annual costs based on the fees |
| Operator fee | 5% / 20% | FBiH 5% of each player payment; RS 20% of payments less payouts; BD KM 1,500 a month per operator seat until 31 July 2027 at the latest, then 20% |

Step-by-step to a live operation
The route in the order the three Acts set, entity by entity. Start by choosing the entity, because capital, guarantee, tax and server location all follow from it.
- 01
Choose the entity and the product
FBiH: betting only; RS: Catalogue games; BD: underlying game plus internet approval
Pick the entity from the “Choosing an entity” table. An online casino or slots operator needs RS or BD; in FBiH only betting operators with at least 50 payment points can hold the internet approval.
- 02
Incorporate a company in that entity
KM 1,500,000 (FBiH) or KM 1,000,000 (RS) capital
The holder must be a legal person seated in the entity. A foreign branch is not accepted. BD sets capital for the underlying game: betting KM 100,000, casino KM 1,000,000.
- 03
Certify the software and place the server
before filing
Obtain the certificate for the internet system from a recognised body (FBiH) or an authorised laboratory (RS, BD), and host the server and data in the entity, or in Bosnia and Herzegovina for BD.
- 04
File the request with the authority
no application window; no games-law deadline
Send the request to the Federal Ministry of Finance, the RS Ministry of Finance or the BD Tax Administration, with the documents listed for your entity and proof of the licence fee.
- 05
Pay the fee and lodge the guarantee
KM 150,000 or KM 300,000; guarantee by entity
The internet fee is KM 150,000 in FBiH and KM 300,000 in RS; BD has none for the internet approval itself. The guarantee is KM 800,000 in FBiH, KM 200,000 in BD and 25% of planned annual fee costs in RS.
- 06
Operate: monthly fee, reports and renewal
5% FBiH, 20% RS, KM 1,500 a month per seat in BD
Pay the operator fee monthly and send the reports each entity requires. Renew at least 30 days before expiry in FBiH and BD, or six months in RS, and display the licence or approval number on the website.

Not legal advice. Checked on 27 October 2026 against the three entity games laws and their rulebooks, the state anti-money-laundering and VAT laws, the registers and notices of the FBiH Ministry of Finance, the RS Ministry of Finance and the BD Directorate for Finance, and the home pages of four operators. Fees, capital and guarantee are stated in Convertible Marks (KM). Where a text is silent the guide says so, and the authority named is the body to ask.
