Sports betting and online casino games are banned in Brazil under Medida Provisória 1.394 of 25 September 2026, including when offered from abroad. Sites and apps had to go offline from 6 October 2026. Domains of the formerly authorised brands now show a federal page, 'Brasil sem Bets — Acesso bloqueado', and the authorities block, notify app stores and social platforms and bar Pix and banks from processing the bets.

Is a site licensed here?

Gambling in Brazil: what you need to know

Money left in your account is refunded through your bank between 9 and 14 October 2026 (where a bank cannot refund, through Caixa from 15 October), and bets still open when the sites closed are cancelled with a full refund. Lotteries are not affected. Congress has until 23 November 2026 to convert the measure (extendable once by 60 days), and the Supreme Court has been asked to suspend it (ADI 8024 and 8027, no ruling as of 23 October 2026).

Shadow market context

Since the ban, the authorities block betting sites, apps and payments

Since 6 October 2026 the .bet.br domains of the formerly authorised brands show the federal page "Brasil sem Bets: Acesso bloqueado". In the first week the Ministries of Justice and Finance sent 10,435 sites for blocking, reported 3,040 social-media pages and notified 186 apps for removal. Banks and payment institutions, Pix included, may not process fixed-odds betting (MP 1.394 art. 14). Offshore sites that still answer are not authorised, and money sent to them has no protection.

Minimum age: 18

You must be 18 to gamble online in Brazil, for online casino and sports betting alike. Lei 14.790 art. 26 I and Portaria 1.231 art. 8 I set 18 for fixed-odds betting (until 25 September 2026); no licensed market remains for it to apply to.

Tax on winnings in Brazil

Until 25 September 2026, winnings from licensed fixed-odds betting were taxed at 15% on net annual prizes above the first band of the annual income tax table (R$ 29,145.60 for 2026). The rule was repealed by MP 1.394 from 25 September 2026 but still applies to bets of the authorised period.

If you won on a licensed site before the ban, the 15% tax applies to your net prizes for the year (prizes minus losses on bets of the same kind) above the first band of the annual income tax table, R$ 29,145.60 for 2026. You assess and pay it yourself through a DARF (code 6313); the operator does not withhold it. The rule was repealed from 25 September 2026 but still applies to bets made while authorisations ran. The rules do not say how winnings from unauthorised operators are taxed.

Rate: Until 25 September 2026: 15% on net annual winnings above the annual personal income tax (IRPF) exemption threshold (R$ 29,145.60 for 2026 (12 x 2,428.80)).

What happens if you play anyway

No operator holds an active online licence in Brazil as of 30 Oct 2026.

No national licence for online gambling exists here, so a site taking deposits from players in Brazil is not licensed locally, whatever licence it shows from elsewhere.

Red flags: how to spot an unlicensed site

  • A .bet.br domain no longer means a site is allowed

Until 25 September 2026 licensed operators had to use a .bet.br domain. That test no longer works: every authorisation ended on 25 October 2026 and betting is banned, so even a .bet.br address is not a licensed site. As of 23 October 2026 the former brands' domains show the federal page 'Brasil sem Bets — Acesso bloqueado'.

  • Verify the Licence on the Official Government List

The SPA page 'Empresas Autorizadas até a vigência da MP nº 1.394/2026' lists 85 authorisations held by 82 companies (update of 9 October 2026). It is a record of who was authorised, not a list of sites you can use: all authorisations ended on 25 October 2026.

  • Be wary of any site that takes your Pix deposit

Until 25 September 2026 licensed sites took Pix, TED, debit or prepaid cards, and credit cards and crypto-assets were barred. Since then banks and payment institutions may not process fixed-odds payments, so a site that still asks you to deposit is outside the law, and a request for a card or crypto payment is a further warning sign.

  • Find Clear Responsible Gambling Tools

Until 25 September 2026 sites had to offer deposit and loss limits, session alerts and access to self-exclusion. The national self-exclusion platform is, as of 23 October 2026, unavailable because of MP 1.394 (SPA page). Offshore sites that still serve Brazil are outside these rules.

Complaints and disputes in Brazil

  1. 1

    1. Contact the Operator Directly

If you still have a balance or a dispute with a former betting site, start with the site's own contact channel. Until 25 September 2026 operators had to run a bettor service in Portuguese, free and open 24 hours a day. The MP orders operators to secure your balance and the banks to refund it; where a bank could not, Caixa Econômica Federal acted as intermediary from 15 October.

  2. 2

    2. File a Complaint on Consumidor.gov.br

If the site does not resolve it, you can file a complaint on consumidor.gov.br, the federal online platform run by the Ministry of Justice. It helps you and the company reach an agreement; it gives no binding decision, and you can still go to court. The SPA's own pages point bettors to it.

  3. 3

    3. Escalate to the Secretariat of Prizes and Bets (SPA)

If you object to the outcome of a site's own investigation of your account, you can tell the SPA, which can open an inspection procedure. The SPA's complaint channel is not described in the published rules; use its 'Fale Conosco' page. Reports about sites that still offer betting can be filed on Fala.BR.

Common myths about gambling in Brazil

  • Myth
My winnings from betting are tax-free.
    Reality

Mostly false. Until 25 September 2026, net prizes from fixed-odds bets were taxed at 15% income tax, and only on the part of the year's net prizes above the first band of the annual income tax table: BRL 28,467.20 for 2025 and BRL 29,145.60 for 2026 (our arithmetic from the monthly tables). The MP repealed art. 31 from 25 September 2026, but it still applies to winnings from the authorised period. The law texts do not say how winnings from sites without authorisation are taxed.

  • Myth
It is fine to bet on a site that still accepts Brazilian players and Reais.
    Reality

False. Since 25 September 2026 betting on sports or online casino games is banned in Brazil, including sites run from abroad, and no site is licensed: every authorisation ended on 25 October 2026. Sites and apps had to go offline from 6 October, and your balance with a former operator was to be refunded through your bank (9 to 14 October; Caixa Econômica Federal from 15 October where banks could not). The former brands' domains show the government page 'Brasil sem Bets — Acesso bloqueado', banks and Pix may not process the payments, and the Ministry of Justice acts against app stores and platforms. The MP itself puts no penalty on the player; an older law fines taking part in a game of chance, even online, from R$ 2,000 to R$ 200,000, and no instrument or court decision says whether it is applied to people betting on offshore sites.

  • Myth
I can deposit with my credit card or crypto.
    Reality

False. Until 25 September 2026 the rules barred betting accounts being funded by credit card, boleto, cash or crypto-assets; only Pix, TED, debit or prepaid cards and transfers within one bank were allowed. Since 25 September 2026 banks and payment institutions, Pix included, may not process fixed-odds payments except to close operations and refund bettors.

Frequently asked questions about gambling in Brazil

Is online betting banned in Brazil?

Yes. Medida Provisória 1.394 of 25 September 2026 bans fixed-odds betting, which covers sports betting and online casino games, also when it is offered to people in Brazil from abroad. Sites and apps had to go offline from 6 October 2026, and every licence ended on 25 October 2026. Caixa and state lotteries are not affected. Congress has until 23 November 2026 to convert the measure (extendable once by 60 days), and the Supreme Court has been asked to suspend it. Former betting domains now show a federal "Acesso bloqueado" page, and banks and Pix may not process betting payments.

What happens to money left in my betting account?

Bettors were told to withdraw by 23:59 on 5 October 2026; from 6 October the sites and apps closed. The operators then sent each balance to the banks, which refund it to your registered account between 9 and 14 October 2026; where a bank cannot refund, Caixa Econômica Federal pays it from 15 October. Bets still open when the sites closed are cancelled with a full refund.

How are gambling winnings taxed in Brazil?

Until 25 September 2026, winnings from licensed betting sites were taxed at 15% income tax on your net prizes for the year (prizes minus losses), above the first band of the annual income tax table: R$ 29,145.60 for 2026. You assess and pay it yourself each year; the operator does not withhold it. The rule was repealed from 25 September 2026 but still applies to bets made before then.

Can I use cryptocurrencies to gamble online in Brazil?

No. Crypto was never allowed on licensed betting sites: deposits in virtual assets were barred, and the only payments allowed were Pix, TED, debit or prepaid card and transfers from your own registered account. Since 25 September 2026 banks and payment institutions, Pix included, may not process fixed-odds betting at all.

How do I complain about a betting site?

Start with the site's own customer service. If that fails, you can file a complaint on consumidor.gov.br, the federal consumer-dispute platform run by the Ministry of Justice, where licensed operators had to register. You can also tell the SPA if you object to how a site handled your account, or go to court.

Were some people barred from betting sites?

Yes. Before the ban, licensed sites had to keep out people with a diagnosed gambling disorder and people receiving Bolsa Família, BPC and certain debt-renegotiation programmes. Since 6 October 2026 no licensed site operates.
