Is online gambling legal in Spain?

RegulatedLicensed: online casino, sports betting, poker, lottery.Research · Data Research revised 28 Oct 2026 (Deep AI Scan of 108 official documents, first researched 24 Sep 2026). Reviewed by Agustina Vuono on 19 Oct 2026; 4 changes to reviewed answers since. Register and enforcement data updated 29 Oct 2026; not part of the review.
Yes

Online casino, sports betting and poker are legal in Spain, but only on sites licensed by the DGOJ, the national regulator; licensed sites use a .es web address. You must be 18, and you prove who you are with your DNI, NIE or passport when you sign up. Every licensed site sets deposit limits, and one free national register, the RGIAJ, lets you ban yourself from all of them at once. Using a VPN to play on unlicensed sites is itself an offence.

Bonuses in SpainNo legal cap on wagering requirements: read the terms before you accept.

Allowed

  • Welcome bonuses can be advertised; the ban on promotions to attract new customers was annulled by the Supreme Court in April 2024 ↗
  • Free bets and free spins as promotions, within the promotion rules ↗
  • The terms must state the minimum deposit, the amount to wager before the bonus and winnings are free, the deadline, and whether it is cash or betting money ↗

Not allowed

  • Promotions aimed at you if you are self-excluded, and any promotion at all if the operator has flagged you as a risk player ↗
  • Offers presented as free or costless when they are not ↗
  • Postal mail promotions, and electronic ones without your consent ↗

Gambling in Spain: what you need to know

Upcoming law change
From 25 March 2027 a new national system adds deposit limits across all your gambling accounts together: €700 a day, €1,750 a week and €3,300 per four weeks. You can change or switch them off, and each site's own limits still apply.

Minimum age: 18

You must be 18 to gamble online in Spain, for online casino, sports betting and lottery alike. 18 for every form of gambling: minors may not take part and Spaniards come of age at eighteen; players aged 25 or under are “young players” with extra protections.

Tax on winnings: some winnings are taxed

Gambling winnings are taxable. Lottery prizes over €40,000 are taxed at source; other winnings must be declared as personal income.

Nothing is taken off your winnings when you are paid. You declare your net gambling gains for the year on your income-tax return, and losses count only up to what you won. Big State lottery prizes (SELAE, ONCE and similar) are the exception: 20% is withheld on the part above €40,000. Non-residents pay 24% (19% if resident in another EU or EEA country that exchanges tax information with Spain).

Rate: Online winnings are income in the IRPF general base, taxed at the progressive scale; losses count only up to the year’s gains, and no tax is withheld. Only prizes of the lotteries and bets of SELAE, the Autonomous Communities, Cruz Roja and ONCE (and equivalent EU/EEA public or non-profit bodies) bear the 20% special levy, on the part above €40,000.

How to check a site is licensed by the DGOJ

There are 78 licensed operators in Spain as of 29 Oct 2026.

Always verify a casino holds a valid Dirección General de Ordenación del Juego (DGOJ) licence before depositing. Check the official register before signing up.

If a site isn't on the regulator's licensee register, ask the regulator before you play: an unlisted site is usually not licensed here (a register can lag behind a new licence). An unlicensed site is outside the regulator's supervision, so you cannot complain to the regulator about it.

Red flags: how to spot an unlicensed site

  • Only a .es address

Licensed operators run a specific .es website and must redirect Spanish traffic to it; the DGOJ tells players to check for the .es domain.

  • Check the DGOJ register

The DGOJ operator search lists every licensed operator, its licences and its domains.

  • Limits you will meet

Deposits are capped at €600 a day, €1,500 a week and €3,000 a month unless you pass the regulator’s test; sessions of casino games and slots start with a time and loss limit you set.

  • Self-exclusion: RGIAJ

One registration bars you at every licensed operator, indefinitely; cancellation only after six months.

  • Help: 900 200 225

FEJAR’s free and anonymous helpline; the DGOJ refers people with a gambling problem to the public health services.

Self-exclusion and problem-gambling help in Spain

Updated · not in the reviewed editionOne answer behind this section was changed by our research team after Agustina Vuono's review of 19 Oct 2026 (edition of 19 Oct 2026). Official source read, AI-assisted checks, published by a person; not formally reviewed.
  • Deposit limit: €600 a day. Also €1,500 a week and €3,000 a month. From 25 March 2027, joint limits across all operators of €700 a day, €1,750 a week and €3,300 per four weeks also apply ↗
  • Reality check: Every 60 min. A self-assessment message with information on your session, such as time played, amounts staked or net losses, which must be read to continue ↗
  • Casino session limits: You set them. A maximum time and a maximum loss before each session, with no default ↗
  • Withdrawals: 24 hours. The operator must order the transfer within 24 hours of your request ↗
How common it is

RGIAJ: General Register of Gaming Access Bans, created under Ley 13/2011 and run by the DGOJ. Free and confidential. Enrol online through the DGOJ electronic headquarters, or on paper at a registry office, the National Police or a gambling establishment. It applies nationwide, is notified to the Autonomous Communities, and lasts indefinitely with a minimum six-month stay; cancelling carries a further three-month reflection period. Registration blocks you from every online operator and from in-person operators that check the register. It is linked by agreement with La Rioja's register, and the BOE of 12 October 2026 published the extension of that agreement (BOE-A-2026-21230): “por un periodo de cuatro años adicionales, hasta el 11 de octubre de 2030”.

Common myths about gambling in Spain

  • Myth
Online winnings are tax-free, or taxed at source.
    Reality

Neither: net annual gains go in the IRPF general base and nothing is withheld. Only State lottery prizes above €40,000 pay the 20% levy at source.

  • Myth
Using a VPN to play on an international site is my own business.
    Reality

Since 2021 it is an infringement fined up to €100,000.

  • Myth
A licensed site can hold my withdrawal as long as it likes.
    Reality

The operator must order the transfer within 24 hours of your request, unless an exceptional cause is notified to the regulator.

Frequently asked questions about gambling in Spain

Are gambling winnings taxed in Spain?

Yes: net annual gains are income in the IRPF general base, and losses count only up to the year’s gains. Licensed operators do not withhold tax. Only State lottery prizes above €40,000 carry the 20% special levy.

Can I use a VPN to play on foreign gambling sites from Spain?

No: since Ley 11/2021, taking part from Spain through IP-masking on sites not licensed in Spain is a minor infringement, fined up to €100,000.

How do I complain about a licensed operator?

Complain to the operator first: it must answer within one month, free and at least in Spanish. After its answer, or a month without one, you can complain to the DGOJ, which decides within two months. Disputes over money are ultimately for the civil courts.

How do I self-exclude from all licensed sites?

Register in the RGIAJ through the DGOJ: the registration bars you at every licensed operator, is indefinite, and can be cancelled only after six months.
